Terms and Conditions for Booking Secure English Language Tests (SELTs)
Introduction
These are the online booking terms and conditions (Terms) of supply for www.ukenglishivi.co.uk. The Site is operated by UKENGLISHVI (we , us and our).

By using our service and having access to the service you have accepted, agreed and bound by these terms. If you disagree with any part of the term then you may not access the service.

If you choose to purchase any product or service through the service (“Purchase”), you will be requested to provide certain information relating to your purchase including, without limitation you debit card number, credit card number, the expiration date of your debit or credit card and you billing address.  

You represent and warrant that: (i) you have the legal right to use any credit cars(s) or payment method(s) in connection with any purchase: and that (ii) the information you have supplied is true, complete and accurate. You also expressly agree that UKENGLISHVI is not responsible or liable for any damage or loss arising from the submission of false and inaccurate information.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.

We reserve the right to cancel or refuse your purchase at any time for certain reasons including but not limited to@ product or service availability, errors in the description or price of the product of service, error in your order or other reasons. You expressly agree that UKENGLISHVI cannot accept any liability for loss or damage arising out of such cancellation.

 

Choosing the correct SELT
It is your sole responsibility to check that you are taking the correct SELT for the purposes for which you intend to use it. As every candidate’s individual circumstances and requirements will vary, it is essential that you make your own enquiries about which level of SELT you should take. We strongly recommend that, before booking your SELT (and depending on the purpose for which you are taking your SELT), you check which SELT you require with your sponsor (your employer or educational institution), an immigration adviser/solicitor, on the Home Office website or on the Transport for London website, as appropriate.

Please note that we are unable to provide immigration advice and that any information provided by us on SELTs is for general guidance purposes only. We accept no responsibility that your choice of SELT is correct for the purposes for which you intend to use it.

Booking your SELT
In order to book your SELT with us you must first make an Entry by completing the application form on the Site which will require you to follow the prompts that will appear on-screen.

You must ensure that any details you provide are accurate. To book a SELT with us, you must provide us with accurate contact information, including your name, postal address, telephone number and email address. Regardless of whether you book the SELT or the SELT is booked on your behalf by a third party,you are responsible for the information provided to us for your booking and for ensuring that the details provided to us are correct and complete, and for informing us of any changes to the information provided.

Please note that the information provided about your identity in your Entry application must match the identity information you bring on the day of the SELT or you will not be able to take the SELT. For further information about identity information, please refer to our Candidate Identification and Security Policy for SELTs.

You may check and correct any input errors in your Entry up until the point at which you submit your Entry to us by clicking the “Pay Now” button on the checkout page.

Following your Entry application, you will receive an e-mail from us acknowledging receipt. Please note that this does not mean that your Entry application has been accepted. Your Entry application constitutes an offer to us to book your Entry at a SELT on a specified day at a specified location. All Entries are subject to approval by us in all cases, and we reserve the right, in our sole and absolute discretion, to decline any Entry, without giving a reason.

You do, however, acknowledge that by clicking on the “Submit” button, you enter into an obligation to pay for the SELT in the event that your Entry is accepted by us. Where we accept your Entry, we will confirm such acceptance by sending you an e-mail thatconfirms that we have accepted your Entry to your chosen SELT (an Entry Confirmation). The Contract will only be formed between the parties when we send you an Entry Confirmation. After entering into the Contract, we will be under a legal duty to provide the SELT as agreed in the Contract.

The Contract will relate only to the SELT that we have confirmed in the Entry Confirmation. We will not be obliged to arrange, or assess you, in any other SELT which may have been part of your booking until your Entry to that other SELT has been confirmed in a separate Entry Confirmation.

Please note that you will not be able to make multiple live Entry applications for the same level of SELT. If you need to book your SELT again because, for example, you did not pass at the first attempt or you had to cancel your booking, you will only be able to re-book the SELT once the first SELT has taken place or your original booking has been cancelled.

If you pass the SELT, you will not be entitled to re-take the SELT or a lower level of SELT for a period of two calendar years from the date when you took your SELT.

Our SELTs are currently available to be taken in the UK only, at the locations stated on the Site.

You are normally able to book your SELT until 9 AM (GMT) on the day before such SELT is due to take place, as long as there is availability for the particular SELT you wish to book. However, you are advised to book as soon as possible to avoid disappointment.

SELT date and location
When you make your Entry on the Site, you will be asked to request a SELT date. The SELTs are run on fixed days of the week, as detailed on the Site, and you will be asked to select the day and date of the SELT that you wish to sit.

Please note that we reserve the right to cancel or postpone a SELT date at short notice or to change the SELT location, in which case you will be entitled, at your discretion, to take the SELT at a proposed later date, or to receive a full refund of any examination fee (an Entry Fee) you have paid to book the SELT on the original date and/or location. If you do not wish to take the SELT at a different date or location, we will process any refund due to you as soon as possible and, in any case, not later than 14 days after the day on which we were informed about your decision to cancel the Contract.

Acceptable Behaviour
If you display threatening, abusive or dangerous behaviour towards us or any of our staff or personnel, then we reserve the right to refuse to allow you to take the SELT. In such circumstances you will not be entitled to a refund of the Entry Fee and we reserve the right to prevent you from sitting any SELT in the future if we feel that is necessary for the protection of our staff or personnel.

Your personal information
When you book your SELT with us on the Site you will need to provide us with certain personal information to enable us to process your application.

If you book your SELT through a third party we will assume that you have given your consent to that third party to process your personal data unless you advise us to the contrary.

Our Privacy Statement sets out how we use any personal information you give us.

Age of consent and entry
If you are making an Entry on your own behalf, you confirm that you are 18 years of age or older and that you are legally capable of entering into binding contracts. If you are under 18 years of age and you wish to enter a SELT, you must get your parent or legal guardian to agree to these Terms and make the Entry and payment on your behalf.

In order to sit your SELT, you must be aged 5 years or above at the time of the SELT.

SELT price and payment
All of our SELTs are subject to an Entry Fee, the prices of which are stated on the Site. Entry Fees may be subject to change from time to time. Changes to our Entry Fees will not affect those SELTs in respect of which we have already sent you an Entry Confirmation.

Booking through our Site may also incur credit card or other transaction charges which are as quoted on our Site at the time of booking, and which may be liable to change from time to time. In accordance with our Privacy Statement, you agree in particular that we may disclose your personal details to our banking suppliers so that they may process your payment in a secure online environment.

The relevant Entry Fee must be paid in full by credit or debit card at the time of making your Entry application. This can be done by following the prompts that will appear on-screen on the Site or by contacting us at the phone number provided on the Site.

If your credit or debit card is declined, your Entry application will not be processed. You will be responsible for making a new Entry application using a valid form of payment.

Entry Fees at present do not include VAT or other sales tax. However, if VAT or any other sales tax becomes applicable between the date of your Entry Confirmation and the date of the SELT, we reserve the right to add the VAT or other sales tax due by you.

You should be aware that online payment transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declines to authorise payment for any reason.

Taking your SELT
All information about SELTs can be found online on the Site and/or in the applicable Regulations

If, due to the time period between booking your SELT and taking the SELT, you are due to take the SELT before the expiry of the Cooling-Off Period, then you expressly request that we begin the supply of services (i.e. the provision of the SELT) before the end of the Cooling-Off Period.

On the day of taking the SELT, you will need to bring a form of identity specified in our Candidate Identification and Security Policy for SELTs. This is for identification and registration purposes and must match the ID details you registered via the Site. Biometrics solutions and/or voice recognition technology will also be used for identification verification.

Please note that the SELT will be recorded using CCTV for identification verification, standardisation, examiner training purposes and to ensure that malpractice does not take place. Further information about this can be found in our Privacy Statement and in the applicable Regulations booklet. If you are a parent or legal guardian contracting on behalf of a minor, you consent to the minor being recorded in accordance with the provisions above.

You can pay when booking your SELT to have it delivered to you securely.

If you pass the SELT, it does not mean that you will be successful in your application for a visa, immigration, citizenship or a private hire driver licence. The exam result and Certificate indicate your aptitude solely for the language element of the application process for a visa, immigration status, citizenship or private hire driver licence but do not guarantee that you will otherwise be successful in your application.

Rescheduling your SELT to a different date
If you wish to reschedule your SELT (the same exam as previously booked) then we will charge you an administration fee (Re-Entry Rate) as follows:

If your request to reschedule your SELT is received more than 3 Office Days before your exam, we will charge a Re-Entry Fee of £30;
If your request to reschedule your SELT is received within 3 Office Days or less before your exam, we will charge a Re-Entry Fee of £60.
An Office Day means Monday to Friday, 9:00am – 5:00pm GMT and Saturday 9:00am – 4:00pm GMT and excludes public holidays in England.

Please note that it is not possible under any circumstances to re-schedule your SELT or to make any changes to your personal details after 10am on the Office Day before the SELT.

If you book a different SELT than the one you were originally scheduled to take, you will not be entitled to benefit from the Re-Entry Rates above and will be charged the full Entry Fee.

Consumer and cancellation rights
You have a statutory right to cancel a Contract within a period of 14 days after the day on which the Contract is entered into (Cooling-Off Period) without giving any reason subject to our right to retain a reasonable portion of the Entry Fee to reflect the work undertaken by us up to the point of cancellation (please see our refunds policy below).

We extend the right to cancel to all bookings of SELTs, whether or not the cancellation is made within or outside the Cooling-Off Period, subject to our terms below.

Nothing in this section affects your legal rights.

If, due to the time period between booking your SELT and taking the SELT, you are due to take the SELT before the expiry of the Cooling-Off Period, then you expressly request that we begin the supply of services (i.e. the provision of the SELT) before the end of the Cooling-Off Period.

Our refunds policy for cancellations
This policy does not apply to exams which we cancel, postpone or for which we change the exam location. Please see the ‘SELT date and location’ section of our Terms for the information about refunds applicable in these specific circumstances.

If you wish to cancel your SELT, we will reimburse payments received from you, subject to our statutory right to retain a portion of the Entry Fee (or Re-Entry Fee, as applicable) to cover our reasonable costs as follows:

If you cancel your exam more than 3 Office Days before the exam is due to take place, we will charge 50% of the Entry Fee (or Re-Entry Fee, as applicable);
If you cancel your exam within 3 Office Days of the exam taking place, we will charge 100% of the Entry Fee (or Re-Entry Fee, as applicable). The same applies if you fail to attend your scheduled SELT on the day of the exam.
An Office Day means Monday to Friday, 9:00am – 5:00pm GMT and Saturday 9:00am – 4:00pm GMT and excludes public holidays in England.

We will process any refund due to you as soon as possible and, in any case, not later than 14 days after the day on which we were informed about your decision to cancel the Contract.

We will refund any money received from you using the same method originally used by you to pay for Entry, unless agreed otherwise.

Our liability
Nothing in these Terms shall limit or exclude our liability to you :

for death or personal injury caused by our negligence;
for fraudulent misrepresentation;
under Part I of the Consumer Protection Act 1987;
or for any other liability that may not, under English law, be limited or excluded.
Subject to this any liability we do have for losses you suffer arising from any Contract shall not exceed the Entry Fee of the relevant SELT and is strictly limited to losses that were reasonably foreseeable. Losses are foreseeable where they could be contemplated by you and us at the time your Entry is accepted by us

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under any Contract that is caused by events outside our reasonable control.

General
You may not transfer or assign any or all of your rights or obligations under any Contract.

All notices given by you to us must be given in writing to the address set out at the end of these Terms. We may give notice to you at either the email or postal address you provide to us when submitting an Entry

If we fail to enforce any of our rights, that does not result in a waiver of that right.

If any provision of these Terms is found to be unenforceable, all other provisions shall remain unaffected.

These Terms may not be varied except with our express written consent.

These Terms and any document expressly referred to in them represent the entire agreement between you and us in relation to the subject matter of any Contract.

These Terms shall be governed by English law. You acknowledge and agree that the place of any service provided by us as a result of entering into a Contract under these Terms is the United Kingdom. You further agree that any dispute between you and us regarding them or any Contract will only be dealt with by the English courts, provided that, if you live in a part of the United Kingdom other than England, the applicable law of that part of the United Kingdom will govern and any dispute will only be dealt with by the courts there.

 

Delays in Certificates: Please note that in some cases certificates take longer to come than expected. We will give information of delivery time of certificate upon registration. This should be taken as a guide. We will not be responsible for the delays; neither can we make a refund if certificates come later than expected

Deadlines or Visa Expiry:It is your responsibility to book and pass your English exams for Home Office well in time before your visa expires. We will not get involved into any such circumstances if you have to meet any deadline and will not accept any liability if you cannot get your certificate before your visa expires.

Changes in Law: We will not take any responsibility if the law changes after you have taken the exam and your certificate is no longer valid for the purpose. We will not make any refunds.

Changes in Venue, Time and Exam: In rare cases we may have to change the date, venue or examining body for the exam. If this happens, we will notify you at the earliest opportunity. If we have to cancel an exam for any reason, we will offer you an alternative date or full refund if the new date is not suitable for you. There will not be any refund available if the exam starts late and you have to wait for little longer for your exam on the exam day.

Non Transferable: The exam fee is non-transferable. You cannot transfer the fee to another exam or to another person.

Delays in Certificates: Please note that in some cases certificates take longer to come than expected. We will give information of delivery time of certificate upon registration. This should be taken as a guide. We will not be responsible for the delays; neither can we make a refund if certificates come later than expected

Collection/Delivery of certificates: Certificates can be collected from our main centres during our opening hours once the candidate receives confirmation of arrival. We can also post your certificate first class, Special recorded delivery at an extra cost of £10. The certificate will be posted via royal mail. We will not be responsible if the certificate is lost via courier.

Exams Booking: The exam will only be booked and confirmed after we have received all the information and full payment. It is up to you to make sure you have provided all the information, documents and the payment is up to date. Failure to complete payment and missing any vital information will result in loss of exam place. Unless agreed otherwise in advance with UKENGLISHVI. 

ID: A valid photo ID details must be provided at the time of registration along with a proof of address. You must also bring original ID documents on the exam day. If you fail to bring correct ID (ID used when registering) as required by College of Skills and Learning, then the candidate will be refused admission into the exam and will lose their place and their fee. Please make sure you bring the correct ID as agreed upon booking.

Failure to attend Exam and Late arrival on Exam Day: Once an exam fee is paid and exam is booked, if you do not attend the exam for any reason you will not be liable for a refund. A full fee will have to be made in order to re-book an exam.

Privacy Policy –  we do not store credit card details nor do we share customer details with any 3rd parties other than awarding bodies for the purpose of certification, however no payment details are stored or share with any 3rd parties including awarding bodies.   

Refunds:  A1, A2, & B1 S&L Once an exam has been confirmed and if you decide to cancel your test, we are unable to return your fee. However if you want to change your date of the exam, we will do our best but this is not guaranteed.  An administration fee may be applicable.  If you decide to cancel your test before we have sent you a confirmation, there will be a charge of £50 for administration cost.  We would normally send all the training materials by email at the time of sending you the test confirmation, however if there are situation that we have sent you the training materials before confirming your test session upon your request and then you decide to cancel your test, we will deduct £55  from your fee for our administration cost.   We will not make any refund if there are any delays for certificates from examining bodies.  Exam confirmations are sent normally within 48 hours of booking, however if the expiry of 48 hours falls over the weekend or on bank holidays, confirmation of test will be sent on the next working day.
